Employers duty to accommodate employees child care obligations reaffirmed

It is the employers duty to accommodate an employees child care obligations. A Fanshaw college professor Amanda Zavits - Gocan filed a grievance against the college in 2011 because they scheduled her classes to begin and end outside the hours of 9am - 5pm. Dr.Zavitz struggled to find child care for her two children aged seven and three. She alleged discrimination on the basis of family status after a college committee denied the professors request to reschedule her classes. The arbitrator indicated that Fanshaw College had made no sincere attempt to asses Dr. Zavitz Gocans request to reschedule her class during times covered by child care. Their was no discussion in regards to assisting her family status as required under the Ontario Human Rights Code. The college has considered implementing a process to assess accommodation requests related to class scheduling.
